They bear the cost of the work and expenses incurred by the Adjoining Owner as a result of the work. Whether you have a good relationship or not, an initial visit or informal chat, along with sharing your plans and proposals, can help get the process started smoothly. From our experience, this simple act of neighbourliness often leads to quicker agreements. Remember, any work on your property, even if unintentional, can disrupt your neighbours. If your neighbours appoint their own independent Surveyor, it’s usually not to cause extra costs, but their right under the Party Wall etc. Act 1996. Im An Adjoining Owner, What Do I Do?

Under the Party Wall etc. Act 1996, an Adjoining Owner is the owner of a property that shares a boundary, wall, or structure with the Building Owner’s property. This can include;

 

  • Owners of neighbouring properties
  • Leaseholds with more than one year remaining on their lease.
  • Freeholders of adjacent land or buildings.

Adjoining Owners have the right to be notified about proposed work covered by the Act and to Consent or Dissent to the Notice. They can appoint their own surveyor or concur to the appointment of an Agreed Surveyor. The Act protects Adjoining Owners’ interests and property during construction work on shared boundaries or structures.

Dissent to the Notice

If you choose to dissent, a Party Wall Award must be in place before the work begins. You can either an Agreed Surveyor, who will act impartially for both parties, or you can appoint your own Adjoining Owner Surveyor. Using an Agreed Surveyor is usually faster and more cost-effective. If you hire your own Surveyor, the Building Owner typically covers their reasonable fees.

Dissenting doesn’t mean you disagree with the work itself, just that you want a Party Wall Award before it starts. Not responding to the Notice won’t delay the proposed works.
