What Is The Party Wall Act?

The Party Wall etc. Act 1996 has its origins in regulations introduced after the Great Fire of London, which led to stricter building controls to prevent future disasters. The Act was established in 1997, becoming a nationwide piece of legislation.

The Act outlines the rights and responsibilities of property owners planning notifiable works and specifies the types of work it covers.

Works subject to the Party Wall Act 1996

Work on an existing wall, ceiling or floor structure shared with another property.

Building on or at the boundary with another property.

Excavating near a neighbouring building or structure.

Examples that fall within the scope of the Party Wall etc. Act 1996 are:

Modifications to existing party walls, such as removal of chimney breasts or projections from a party wall, insertion of structural beams into a party wall, cutting flashings into party walls, raising or lowering party walls (loft conversion / basements).

Works affecting ceiling/floor structures between different owners

New walls on the boundary between properties, either up to the boundary or sitting astride a boundary.

Excavations within 3 meters of a neighboring property and to a greater depth then the neighbour property’s foundations, for example a 1.2m deep foundation for a domestic extension, adjacent to a property property built circa 1900’s.
